Can adapted sanitary facilities be provided at another nearby location?

The amendment to the Building Act, which entered into force at the end of 2025, allows that in the case of reconstructions of existing buildings or parts of buildings, where accessible sanitary facilities cannot be provided due to lack of space, these may also be provided at another publicly accessible location that is no more than 150 m away from the building.

However, as this is only a permitted exception under the stated condition, adapted sanitary facilities must be established in all buildings where sanitary facilities are available for other users and where this can be reasonably achieved.

If, due to spatial constraints or other justified reasons (technical infeasibility, deterioration of essential building requirements, disproportionate costs, or cultural heritage protection regimes), the facilities are nevertheless provided at another location within the prescribed distance of 150 m from the building, it must be ensured that they are also available to users in practice.
This includes providing all necessary information about the location of the adapted sanitary facilities so that users can find and use them—for example, at building entrances, with the surroundings equipped with signage, area maps indicating the facilities, etc., and it is also recommended to provide this information on the institution’s website to ensure maximum visibility and accessibility.

In cases where the adapted sanitary facilities are located within the premises of another institution, it is particularly important to ensure organizationally that the facilities are available throughout the entire operating hours of your building and are not subject to the working hours of other institutions.

Persons with mobility impairments face many barriers in their daily lives. Let us ensure that something as basic as access to an appropriate toilet is not one of them.
